Know Your Constitutional Rights
The First Amendment to The Constitution provides five basic protections for the freedom of speech, religion, and the press, as well as the rights to peaceful assembly and petition the government.
Although the First Amendment included in the Bill of Rights protects civil liberties under U.S. law, there are limitations to its protections. For example, speech that is considered obscene or that threatens violence is excluded from protection under the First Amendment, however determining what words fall under these categories is debatable, and is typically decided on a case-by-case basis.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Why Hire a Constitutional Rights or First Amendment Attorney?
Being an American affords you protections to express yourself without government interference or regulation. When these rights are violated, you have the inalienable right to pursue legal recourse.
Hiring an aggressive attorney who can inform you of your constitutional rights and advise you on your best course of action can mean the difference in outcome.
I am a Pueblo attorney who has committed to being the voice of human rights and speaking up against the government and corporations for those who cannot speak for themselves. I will fight for your rights and am not afraid to take on the government and governmental employees.

What is considered a 1st Amendment violation?
Examples of Possible 1st Amendment Rights Violations
If you have experienced any of the following examples from local, state or federal government officials, you MAY have experienced a Constitutional rights violation, and should speak to an experienced civil rights attorney to evaluate your case.
- Censorship or have been refused printing or broadcasting content on media that is within the context of appropriate verbiage, or denial of the right to freely express a controversial opinion.
- Not being allowed to express yourself without government interference or regulation.
- Limited or censoring local, state, national, and global news information
- Failure to allow you or your religious sect to practice your faith and live out or promote your moral beliefs.
- Interference or denial of space or time to assemble by the police.
- Denied the right to lobby and petition local, state, and federal officials to modify ordinances, policies, and laws you find offensive or ineffective.
What is NOT considered a 1st Amendment violation?
Examples of possible 1st Amendment rights exceptions
Although the First Amendment protects free speech, it applies only to restrictions that are imposed by the government, and not private schools, private employers, and landlords for instance. In addition, certain types of speech are exempt from First Amendment protection.
- You are fired by a private employer because of your expression of speech.
- A private university suspends or expels you for something you said.
- You have been banned or blocked from posting your views on social media.
- Censorship from speech that includes true threats, blackmail, defamation/libel, child pornography, obscenity, perjury, plagerism, solicitation to commit a crime, or illegal activity.
When in doubt, your best course of action is to obtain legal advice. The First Amendment laws can be very complicated and subject to interpretation. An experienced legal professional who knows Constitutional Law, Civil Rights Law, and First Amendment rights can help you determine if you have a case.

I was able to get resolve and the city realized it was violating my civil rights. All this would not have been possible without Matt’s knowledge in civil rights and his expertise with the justice system.
Janet W.Client
Mr. Martin did the hard work necessary to prove that the managed care contract was vague and confusing and ultimately we prevailed in court. Many other attorneys would not have touched this case. Mr. Martin won it.
